I see bumper stickers around here saying "Put Teachers First."

They reference the state government budget process and the issue of teacher pay.

One of these days, I'm gong to knock on the window of someone with one of those stickers and ask her, "What happened to putting the children first?"

The Federalist[/I] has an article today proposing that if K-12 schools were working, we wouldn't "need" affirmative action. It goes through the problems at home, and the ineffectiveness of schools to close the performance gap shown by "underprivileged" kids.

It's worth a read if you're paying taxes.

My Pillow is fighting more battles in court.

I reported earlier this month that two early investors in the My Pillow concept sued the Chanhassen company and founder Mike Lindell, alleging that he wrongfully took the intellectual property rights behind the foam-filled product and denied them ownership of what's now a fast-growing company.

My Pillow refused to pay and said it had to lay off workers after the deal went bad.

The My Pillow employee who charged the payment, Vice President of Show Management James Furlong, sued Salesforce.com, American Express and My Pillow to get the charge reversed.

Salesforce.com's lawsuit seeks more than $550,000 from My Pillow for breach of contract.

My Pillow denied owing money to Salesforce.com, American Express or Furlong.

The investor lawsuit could go to a jury trial as soon as October, court records show.

TINA.org shared its information with the California consumer groups, and last month the district attorneys of 10 counties filed a lawsuit alleging that My Pillow “knew or reasonably should have known” that the marketing claims were likely to mislead consumers.

The result was a stipulated judgment, meaning the company admitted no wrongdoing, that included $995,000 in civil penalties and a pledge to give $100,000 to homeless and domestic violence shelters in California.

“We decided to pay out rather than pay millions to prove our innocence,” Lindell told the Star Tribune in Minnesota, where the company is based.

In addition, My Pillow must stop promoting itself as the “official pillow” of the National Sleep Foundation because it failed to disclose its financial connection with the foundation to consumers.

“Companies making millions from unsupported health claims that are warned by TINA.org to halt their deceptive marketing practices are going to pay a price if they don’t comply,” said TINA.org Executive Director Bonnie Patton.

The troubles My Pillow has seen this year are enough to keep anyone up nights. In August, New York's attorney general, Eric Schneiderman, announced a $1.1 million settlement that resolved a whistleblower case against My Pillow that alleged that My Pillow knowingly failed to collect and remit sales tax on purchases made by New Yorkers over the phone or internet.

Based on the investigation, the attorney general contended that My Pillow failed to collect and remit $537,000 in New York sales taxes from 2011 to 2015. Again, My Pillow denied any wrongdoing.

Earlier this year, Consumer Reports bought three My Pillows to test and examined them inside and out. Although we did not issue any ratings, one tester described the pillow as “kind of lumpy, but comfortable.”

We also polled staffers who bought My Pillow on their own in hopes of getting a better night’s sleep. Half said the pillow helped them sleep, and one-third said it didn’t help at all.

I noticed the false advertising lawsuit a month or two ago. The sales-tracking software thing is new to me. If I went into hock for a $125,000 tracking system that didn't work, I'd withhold payment, too. Let's see how the details flesh out. Not a lot of meat in that Biz Journal article.

Around here we've (I've) never heard health claims in the ads, although the "Sleep Foundation" thing is a staple. On both of those fronts, I'm suspicious that California commonly goes overboard in "consumer protection" cases. [I]C'est la vie.[/I]

Lastly, as far as I'm concerned, NY can go pound sand on the sales tax claim. I am an internet sales = no tax purist, and doubly so when there is absolutely no physical presence by a company in the state or jurisdiction.


I actually did buy a My Pillow about six months ago when I saw them in Walmart. I remembered Crookedeye saying that he had $50 burning a hole in his pocket and that he was gonna spend it on a My Pillow a couple of years ago, and I said to myself "Hell, yeah. Be like Rick."

There wasn't a "Get a second one free; just pay a separate handling charge" offer at Walmart, so I can only boast one specimen. And it's not even the one they recommend for guys, or guys my size, or however they do it. It works great for me, though.

So, until something new happens, I'm still on the Mike Train...

So I'm driving and listening to the radio when a good ol' "My Pillow" commercial comes on. I didn't realize that the pillow comes with instructions. Whoa! That sucks. Can you imagine getting one of these on Christmas morning and before you can put your head on it, your dad has to spread out the instructions on the floor and systematically go through the parts list while your mom is going through the care and instructions information. I hate that.
